OFFICIAL RULES
PLEASE READ OFFICIAL RULES CAREFULLY BEFORE ENTERING.
By entering any PinSeekerz competition, you agree to be bound by these Official Rules and the decisions of PinSeekerz, which are final in all matters.
Draft Official Rules- Subject to Final Legal Review Prior to Launch
1. ACCEPTANCE OF OFFICIAL RULES
• By submitting an entry, the participant agrees to be bound by these Official Rules, the Participant Waiver, the Terms of Service, the Privacy Policy, any course-specific rules displayed for the participating club, and PinSeekerz's good-faith verification decisions.
• If there is a conflict between these Official Rules and advertising, signage, website copy, or other promotional material, these Official Rules control with respect to eligibility, shot validity, verification, and prizes.2. ELIGIBILITY
• Open only to individuals age 18 or older who are amateur golfers, are legally eligible to participate, and are physically playing a normal round of golf at a participating PinSeekerz club in Florida.
• Participants must comply with the participating club's membership, guest, tee-time, pace-of-play, dress, conduct, and course rules.
• Employees, officers, directors, owners, contractors, agents, and representatives of PinSeekerz; individuals directly involved in administration or verification of the challenge; and their immediate household members are not eligible unless PinSeekerz publishes a written exception approved by counsel.
• PinSeekerz may require reasonable proof of age, identity, amateur status, round participation, tee assignment, or other eligibility information before awarding a prize.3. OPTIONAL ENTRY; ENTRY FEE; TIMING
• Participation is entirely optional and is separate from the purchase of a golf round, membership, greens fee, cart fee, or other club services.
• The current entry fee is $5 per round. The same $5 entry fee applies whether the participant is playing 9 holes or 18 holes. One valid entry covers all designated PinSeekerz holes encountered during that round.
• Entry and payment must be fully completed and timestamped before the participant takes any qualifying shot on a designated PinSeekerz hole. An entry made after a qualifying shot begins is invalid for that shot and for any earlier shot in the round.
• Entries are personal, non-transferable, and may not be assigned to another golfer. A person paying on behalf of a guest must identify the actual participating golfer as required by the entry process.
• Entry fees are non-refundable except where required by law or when PinSeekerz determines that all designated challenge holes available to that participant during the round were unavailable. There is no prorated refund solely because fewer designated holes are encountered during a 9-hole round, because one designated hole is unavailable, or because a participant does not complete the round.4. DESIGNATED HOLES AND QUALIFYING SHOTS
• Only holes specifically designated as active PinSeekerz challenge holes for that club and round are eligible.
• The participant must play from the teeing area assigned or authorized by the participating club for that participant's normal round. Moving to a materially shorter tee solely for the challenge is not permitted unless the club's published course-specific rules expressly allow it.
• Only one qualifying shot per participant, per designated hole, counts. The qualifying shot is the participant's first normal-play stroke from the designated teeing area on that hole.
• Mulligans, practice balls, warm-up shots, replays, second balls, extra shots, or shots taken after the participant has already played a normal qualifying stroke on that hole are not eligible.
• The shot must be made during ordinary play of the round, without artificial assistance or manipulation beyond equipment and conduct permitted by the Rules of Golf and the participating club.5. SKILL-BASED OUTCOME AND BALL POSITION
• Winning outcomes are determined solely by the participant's golf shot and the final resting position of the ball, subject to these Official Rules and verification.
• The ball must come to rest naturally and without assistance. A ball that is intentionally moved, stopped, redirected, placed, kicked, blown, carried, or otherwise manipulated by any person or unauthorized object is not eligible.
• If a ball is moved by an outside influence or an abnormal course condition, PinSeekerz may apply the applicable Rules of Golf and available video evidence to determine whether the shot can be fairly verified.6. PRIZES
• Hole-in-One: $1,000 cash for a verified hole-in-one on a designated PinSeekerz hole.
• Inside 2 Feet: $500 pro shop credit when a verified qualifying shot finishes inside the applicable 2-foot proximity standard, as determined by the approved measurement method.
• 2 Feet Through 4 Feet: $100 pro shop credit when a verified qualifying shot finishes outside the 2-foot prize standard but within the applicable 4-foot proximity standard, as determined by the approved measurement method.
• Prizes do not stack for the same shot. If a single qualifying shot could satisfy more than one prize category, the participant receives only the highest-value applicable prize.
• Prizes are fixed in advance, do not depend on the number of entries or amount of entry-fee revenue, and are independently funded or otherwise unconditionally assured by PinSeekerz before entries are accepted.
• Pro shop credit is subject to the participating club's reasonable redemption procedures and is not redeemable for cash unless PinSeekerz or the club expressly states otherwise in writing.7. PROXIMITY MEASUREMENT
• Proximity prizes are determined using the official PinSeekerz-approved measuring device, marker, zone, or measurement procedure installed or supplied for the designated hole.
• The official measurement is made only after the ball has come to rest and before it is lifted or intentionally moved. The participant must not move the ball before the required measurement or verification is completed.
• If a course employee or PinSeekerz representative is required to perform or confirm the measurement, that determination controls absent clear video evidence of an error.
• Course-specific instructions may describe the exact physical marker or zone used at a particular club. Those instructions are incorporated into these Official Rules for that club.8. VIDEO AND COURSE VERIFICATION
• Designated challenge holes may be monitored by video or other verification technology. Entry timestamps, video footage, course records, staff confirmation, measurement records, and other available evidence may be reviewed to verify a potential winning shot.
• A potential winner must cooperate with reasonable verification requests, including providing their name, contact information, round information, playing partners, scorecard, identification, and any claim or tax forms reasonably required.
• PinSeekerz may withhold a prize until verification is complete. A prize is not considered won or owed until the shot and participant have been verified under these Official Rules.
• If a technical failure prevents reliable verification, PinSeekerz will use available evidence in good faith. If the shot cannot be reliably verified, the prize may not be awarded. If all designated challenge holes available to the participant are non-operational before play, the participant may be entitled to a refund under Section 3.
• Camera footage is used for administration, verification, safety, fraud prevention, and related purposes as described in the Privacy Policy. It does not guarantee that every shot will be continuously recorded or preserved indefinitely.
9. MULTIPLE WINNERS; NO TIE-BREAKER
• PinSeekerz prizes are not limited to a single winner. Every participant who independently satisfies a prize condition and is verified under these Official Rules is entitled to the applicable prize.
• Ties do not reduce, divide, split, or eliminate a verified participant's prize. No drawing, random selection, or tie-break procedure is used to determine which otherwise-qualified participant receives a prize.10. WINNER NOTIFICATION AND CLAIM PROCESS
• Potential winners should notify participating club staff or PinSeekerz as soon as reasonably possible after a qualifying result and follow the posted claim instructions.
• PinSeekerz may contact a potential winner using the email address, phone number, or other information provided at entry. The participant is responsible for providing accurate contact information.
• Potential winners must timely complete any reasonable claim, eligibility, tax, affidavit, release, witness, club-verification, or notarization documents required by PinSeekerz, a participating club, or an applicable prize provider or insurer.
• Failure to provide required verification materials within the deadline stated in the winner notice or claim documents may result in forfeiture if PinSeekerz cannot otherwise verify eligibility and the winning shot.11. TAXES AND PRIZE DELIVERY
• Winners are solely responsible for any federal, state, or local taxes, reporting obligations, or other costs associated with receipt or use of a prize, except where PinSeekerz expressly agrees otherwise in writing.
• Cash prizes will be paid using a method selected by PinSeekerz after verification. Pro shop credit will be issued through or for use at the applicable participating club, subject to club procedures.
• PinSeekerz may require tax documentation, including a completed IRS Form W-9, before issuing a prize when required by law.12. PROHIBITED CONDUCT AND DISQUALIFICATION
• Fraud, collusion, falsified identity or round information, false claims, tampering with cameras or measuring equipment, moving a ball before required verification, intentionally obstructing verification, or any attempt to manipulate the challenge is prohibited.
• Participants may not interfere with another player's shot, ball, measurement, video evidence, entry, or claim.
• PinSeekerz may disqualify a participant or deny a claim when reliable evidence shows a material violation of these Official Rules, provided the decision is made in good faith and based on the available evidence.13. COURSE CONDITIONS; SUSPENSION; CANCELLATION
• PinSeekerz or the participating club may temporarily suspend a designated hole because of weather, lightning, darkness, maintenance, tournament operations, safety concerns, equipment failure, course closure, or other conditions affecting fair or safe administration.
• No qualifying shot may be taken for PinSeekerz prize purposes while a designated hole is marked inactive, closed, suspended, or unavailable.
• PinSeekerz may modify or discontinue the challenge prospectively if necessary for safety, legal compliance, insurance, operations, or circumstances beyond its reasonable control. Any change will not retroactively invalidate a prize that was already validly earned and verified under the rules in effect at the time of the shot.14. ASSUMPTION OF RISK; PARTICIPANT WAIVER
• Golf involves inherent risks, including errant shots, uneven terrain, weather, carts, equipment, water hazards, wildlife, and other conditions. Participation in PinSeekerz does not alter the participant's responsibility to play safely and comply with club rules.
• Participation is also subject to the separate PinSeekerz Participant Waiver, which is incorporated by reference. If there is a conflict, these Official Rules govern challenge eligibility and prize criteria, while the Participant Waiver governs assumption of risk and release-related matters to the extent permitted by law.15. PRIVACY
• Personal information, entry records, payment-related information, verification records, and video footage are handled in accordance with the PinSeekerz Privacy Policy.
• Payment-card information may be processed by third-party payment providers. PinSeekerz should not be described as directly storing full payment-card numbers unless that is actually true of the implemented payment system.16. PUBLICITY
• PinSeekerz may announce verified winners and may request permission to use a winner's name, likeness, photograph, video, club, or prize result for promotional purposes. Where required by law, any broader publicity use will be subject to separate consent.17. LIMITATION OF LIABILITY
• To the fullest extent permitted by law, PinSeekerz is not responsible for losses caused by unauthorized access, internet or payment-processing failures, delayed or corrupted transmissions, participant device failures, or other technical issues outside PinSeekerz's reasonable control, except to the extent caused by PinSeekerz's own conduct for which liability cannot legally be disclaimed.
• Nothing in these Official Rules is intended to waive rights or impose limitations that cannot lawfully be waived or limited under applicable law.18. CHANGES TO RULES
• PinSeekerz may update these Official Rules prospectively for legal, operational, insurance, technology, prize, or course-related reasons. The version in effect when the participant enters and takes the applicable qualifying shot will govern that shot, except where a change is required by law.
• The current version and effective date will be posted at pinseekerz.co.19. GOVERNING LAW; SEVERABILITY
• These Official Rules are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, subject to any non-waivable rights under applicable law.
• If any provision is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

PARTICIPANT WAIVER
Please read carefully before entering any PinSeekerz competition.
By entering a PinSeekerz challenge, I acknowledge that I have read, understand, and agree to the following terms.
1. Voluntary Participation
I understand that participation in PinSeekerz is entirely voluntary and is an optional addition to my normal round of golf.
2. Assumption of Risk
I understand that golf and activities occurring on or around a golf course involve inherent risks, including, without limitation, risks associated with golf balls, golf clubs, golf carts, course conditions, weather, other players, spectators, and normal golf-course activities.I voluntarily assume the risks reasonably associated with my participation in the PinSeekerz challenge.
3. Release of Liability
To the fullest extent permitted by applicable law, I release and hold harmless PinSeekerz, its owners, officers, employees, contractors, agents, insurers, participating golf clubs, and service providers from claims arising from ordinary risks associated with my voluntary participation in the PinSeekerz challenge.Nothing in this Waiver is intended to waive rights that cannot legally be waived.
4. Compliance With Official Rules
I agree to comply with the PinSeekerz Official Rules, as well as all rules and policies of the participating golf club.I understand that prize eligibility depends upon satisfying all applicable entry, eligibility, shot, measurement, and verification requirements contained in the Official Rules.
5. Entry Before Play
I understand that my PinSeekerz entry must be successfully completed before taking any qualifying shot for which I seek prize eligibility.An entry submitted after a qualifying shot has been taken does not make that shot eligible for a prize.
6. Eligibility and Accurate Information
I represent that I satisfy the eligibility requirements contained in the Official Rules.I agree that all information I provide in connection with my entry or any prize claim will be truthful, complete, and accurate.Providing false, misleading, or fraudulent information may result in disqualification and forfeiture of any prize.
7. Video Recording and Verification
I understand that designated PinSeekerz holes may be monitored and recorded by video or other verification technology.I consent to the recording and review of my qualifying shots for purposes including:- determining prize eligibility;
- verifying winning shots;
- investigating disputes or suspected fraud;
- administering claims; and
- maintaining the integrity of the PinSeekerz program.Recordings will be handled in accordance with the PinSeekerz Privacy Policy and applicable law.
8. Course and Staff Verification
I understand that potential winning shots may be reviewed using video footage, course records, measurement information, participating-club personnel, and other reasonable verification methods.I agree to reasonably cooperate with PinSeekerz and participating club personnel during any prize-verification process.
9. Prize Claims
I understand that a potential winning shot does not automatically create a right to a prize.All prizes are subject to verification and compliance with the Official Rules.I may be required to provide additional information or complete reasonable claim documentation before a prize is issued.
10. Taxes and Other Obligations
I understand that I am responsible for any federal, state, or local taxes or reporting obligations associated with a prize I receive, unless otherwise required by law.
11. No Guarantee of Participation or Prize
I understand that participating golf clubs, eligible holes, challenge availability, prize offerings, and program operation may change from time to time.Participation does not guarantee that I will win a prize.
12. Electronic Agreement
By selecting the acceptance checkbox during entry and submitting payment, I acknowledge that:- I have had the opportunity to review this Participant Waiver;
- I have read and agree to the Official Rules and Terms of Service;
- I acknowledge the Privacy Policy;
- I voluntarily agree to this Participant Waiver; and
- my electronic acceptance has the same effect as my written signature to the extent permitted by law.
IMPORTANT
If you do not agree to this Participation Waiver, do not enter the PinSeeker challenge. Participation in a PinSeekerz challenge is conditioned upon acceptance of this Waiver and the applicable Official Rules.

This Privacy Policy applies to the PinSeekerz website, entry and payment experience, communications, participating-course challenge operations, prize claims, verification activities, and other services that link to or reference this Policy (collectively, the “Services”).
1. INFORMATION WE COLLECT
We may collect personal information directly from you, automatically when you use the Services, from participating golf clubs, and from service providers involved in operating PinSeekerz.
• Contact information, such as your name, email address, phone number, and mailing address when needed.
• Eligibility and round information, such as age confirmation, participating golf club, tee time, round date, playing status, tee assignment, and other information reasonably needed to determine eligibility.
• Entry and transaction information, such as entry date and time, amount paid, transaction identifier, payment status, and related records.
• Prize-claim and verification information, such as scorecards, playing-partner information, witness information, identification, tax forms, claim forms, course confirmation, and other information reasonably necessary to verify and fulfill a prize.
• Communications and support information, including messages, inquiries, feedback, and records of communications with PinSeekerz.
• Website and device information, such as IP address, browser type, device type, operating system, pages visited, referring pages, timestamps, and similar technical or usage data.2. PAYMENT INFORMATION
Payments may be processed by one or more third-party payment processors. PinSeekerz does not intend to directly store full payment-card numbers when those details are handled by the payment processor.
PinSeekerz may receive transaction-related information from the payment processor, such as payment confirmation, transaction identifier, billing name, card brand, limited card details such as the last four digits, fraud-screening results, refunds, disputes, and other information needed to administer the transaction.
Payment processors process payment information under their own terms, privacy notices, and security practices.3. VIDEO RECORDING AND CHALLENGE VERIFICATION
Designated PinSeekerz challenge holes may be monitored or recorded by cameras or other verification technology. Video may capture participants, playing partners, course staff, golf shots, ball movement, the green, teeing areas, surrounding course activity, and other persons or activity within the camera’s field of view.
PinSeekerz may use video and related verification records to:
• verify potential winning shots and prize eligibility;
• confirm compliance with the Official Rules;
• review measurements, ball position, shot sequence, and other facts relevant to a claim;
• investigate disputes, suspected fraud, tampering, or prohibited conduct;
• support insurance, prize-administration, legal, or claim requirements;
• protect the integrity and security of the PinSeekerz program; and
• address operational, safety, or technical issues involving challenge equipment.
PinSeekerz does not use challenge video for facial recognition, facial surveillance, or the creation of biometric identifiers. If that practice ever changes, PinSeekerz will update this Policy and provide any notice or consent required by applicable law.
Video monitoring does not guarantee that every shot, person, or event will be continuously recorded, clearly visible, or retained. A recording may be unavailable because of equipment failure, connectivity, obstruction, environmental conditions, storage limits, maintenance, or other circumstances.4. HOW WE USE PERSONAL INFORMATION
We may use personal information for the following business and operational purposes:
• process entries and payments;
• administer PinSeekerz challenges at participating golf clubs;
• confirm eligibility and round participation;
• verify potential winning shots and prize claims;
• communicate with participants about entries, claims, prizes, support requests, or important service information;
• fulfill prizes and maintain related records;
• detect, investigate, and prevent fraud, abuse, manipulation, and violations of the Official Rules;
• operate, secure, maintain, troubleshoot, and improve the Services and challenge technology;
• perform analytics and understand how the website and Services are used;
• maintain accounting, tax, insurance, legal, and business records;
• establish, exercise, or defend legal claims and enforce our agreements and policies; and
• comply with applicable law, lawful requests, regulatory obligations, and court orders.5. PARTICIPATING GOLF CLUBS
PinSeekerz works with participating golf clubs to operate and verify challenges. We may share or receive information with a participating club when reasonably necessary to confirm that a participant was playing a qualifying round, determine whether a designated hole was active, verify a potential winning shot, complete a measurement or claim, issue pro shop credit, investigate a dispute, or otherwise administer the program.
Participating clubs may separately collect personal information through their own tee-time, membership, point-of-sale, security, or other systems. Information independently collected by a club is governed by that club’s own privacy practices.6. HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:
• participating golf clubs;
• payment processors, banks, and financial service providers;
• hole-in-one insurers, prize providers, and prize-fulfillment providers;
• camera, video-hosting, cloud-storage, software, website-hosting, analytics, communications, and other technology providers;
• professional advisers, including attorneys, accountants, auditors, and insurance professionals;
• government agencies, courts, regulators, law enforcement, or other parties when disclosure is required or permitted by law;
• parties involved in a merger, financing, acquisition, sale, reorganization, or similar business transaction; and
• other parties when you direct us to disclose information or provide consent.
PinSeekerz does not sell personal information for money. PinSeekerz does not provide challenge-verification video to sponsors or advertisers for targeted advertising
7. WINNERS, PUBLICITY, AND PROMOTIONAL CONTENT
PinSeekerz may announce verified winners and may request permission to use a winner’s name, photograph, likeness, video, participating club, prize result, or related story for promotional purposes.
Where applicable law or the circumstances require separate consent for promotional use, PinSeekerz will request that consent separately. Declining optional promotional consent will not invalidate an otherwise verified prize.8. COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES
The PinSeekerz website may use cookies, pixels, local storage, analytics tools, or similar technologies to operate the website, remember preferences, understand website usage, detect technical problems, measure performance, and improve the Services.
Third-party services embedded in or connected to the website, including payment processors, may use their own cookies or similar technologies in accordance with their privacy notices.
You may be able to control certain cookies through your browser or device settings. Disabling certain technologies may affect website functionality.9. MARKETING COMMUNICATIONS

If PinSeekerz offers text-message marketing, participation will be subject to the applicable opt-in terms and available opt-out instructions.10. DATA RETENTION
PinSeekerz retains personal information only for as long as reasonably necessary for the purposes described in this Policy, including challenge administration, prize verification and fulfillment, fraud prevention, accounting, tax, insurance, legal, dispute-resolution, and recordkeeping purposes.
Retention periods may vary depending on the type of information and the reason it was collected. Video associated with a potential winning shot, disputed claim, fraud investigation, insurance matter, or legal matter may be retained longer than routine footage when reasonably necessary.
When information is no longer reasonably needed, PinSeekerz may delete, deidentify, aggregate, or otherwise dispose of it, subject to applicable legal and operational requirements.11. DATA SECURITY
PinSeekerz uses reasonable administrative, technical, and organizational safeguards intended to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.
No website, internet transmission, camera system, cloud service, or electronic storage method can be guaranteed to be completely secure. Accordingly, PinSeekerz cannot guarantee absolute security.12. YOUR PRIVACY CHOICES AND RIGHTS
Depending on where you reside and applicable law, you may have rights relating to your personal information, which may include the right to request access, correction, deletion, or a copy of certain personal information, or to appeal a decision concerning a privacy request.
PinSeekerz may need to verify your identity before processing a request and may retain or decline to delete information when permitted or required by law, including records needed for transactions, fraud prevention, legal claims, taxes, insurance, or compliance.

If we learn that personal information was collected from a person who was not eligible because of age, we may delete or otherwise handle that information as appropriate and permitted by law.14. THIRD-PARTY WEBSITES AND SERVICES
The Services may contain links to participating golf clubs, partners, sponsors, payment providers, or other third-party websites and services. PinSeekerz is not responsible for the privacy practices, security, or content of third parties. We encourage you to review the privacy notices of those third parties.15. BUSINESS TRANSFERS
If PinSeekerz is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, personal information may be disclosed or transferred as part of evaluating, negotiating, or completing that transaction, subject to applicable law.16. TERMS OF SERVICES
These Terms of Service govern your access to and use of the PinSeekerz website, services, entry system, challenge technology, and related features. By accessing the website, submitting an entry, or otherwise using the Services, you agree to these Terms.

By submitting an entry or otherwise using the PinSeekerz service, you acknowledge that you have read and agree to these Terms of Service.

1. ABOUT PINSEEKERZ
PinSeekerz operates optional, skill-based golf challenges at participating golf clubs.
Participation in a PinSeekerz challenge is separate from the purchase of a golf round and is subject to the applicable Official Rules, Participant Waiver, and Privacy Policy.
Nothing in these Terms guarantees the availability of PinSeekerz at any particular golf club, on any particular date, or for any particular round.2. ELIGIBILITY
You may use the PinSeekerz Services only if you satisfy the eligibility requirements contained in the applicable Official Rules.
You are responsible for providing accurate and complete information when entering a challenge, submitting a claim, or otherwise using the Services.
PinSeekerz may refuse, suspend, or cancel participation if eligibility requirements are not satisfied.3. ENTRIES AND PAYMENTS
Challenge entries must be completed in accordance with the applicable Official Rules.
Entry fees must be paid before taking any qualifying shot for which prize eligibility is sought.
Payments may be processed by a third-party payment processor. By submitting payment, you authorize the applicable payment provider to charge the payment method you provide for the amount displayed at checkout.
PinSeekerz may maintain records of transaction status, timestamps, payment confirmation, and other information necessary to administer entries and claims.4. REFUNDS AND CANCELLATIONS
Unless otherwise stated in the applicable Official Rules or required by law, challenge entry fees are generally non-refundable once an entry has been successfully submitted.
PinSeekerz may issue a refund or credit when it determines that a challenge was unavailable due to a technical, administrative, or operational issue.
A participant is not entitled to a refund merely because the participant:
• does not complete the round;
• does not play an eligible hole;
• misses or skips an eligible hole;
• does not win a prize; or
• is disqualified for failure to comply with the Official Rules.
Any final refund policy should match the language used during checkout.5. OFFICIAL RULES CONTROL PRIZE ELIGIBILITY
All matters involving challenge eligibility, qualifying shots, measurements, verification, prizes, claims, and winner determination are governed by the applicable Official Rules.
If these Terms conflict with the Official Rules on a matter involving a challenge or prize, the Official Rules control.6. PARTICIPATING GOLF CLUBS
Participating golf clubs are independent businesses and are not employees, agents, or joint ventures of PinSeekerz unless expressly stated otherwise.
Golf clubs remain responsible for their normal course operations, including tee times, course conditions, golf carts, local rules, member policies, and ordinary golf-course activities.
PinSeekerz is responsible only for the aspects of the PinSeekerz program that it expressly manages.7. VERIFICATION AND TECHNOLOGY
PinSeekerz may use cameras, software, timestamps, course personnel, measurement devices, transaction records, or other verification methods to administer challenges and verify potential winning shots.
The operation of these systems may occasionally be affected by:
• internet or cellular connectivity;
• camera or equipment failure;
• power interruptions;
• weather;
• obstruction of the camera view;
• software or hardware issues;
• maintenance;
• third-party service interruptions; or
• other circumstances outside PinSeekerz’s reasonable control.
PinSeekerz does not guarantee uninterrupted or error-free operation of any technology used in connection with a challenge.8. ACCEPTABLE USE
You agree not to misuse the PinSeekerz website, Services, challenge technology, or verification systems.
You may not:
• submit false or misleading information;
• impersonate another person;
• attempt to submit an entry after taking a qualifying shot;
• manipulate, obstruct, disable, damage, or interfere with cameras or verification equipment;
• alter or falsify scorecards, measurements, timestamps, video, or claim information;
• attempt to improperly obtain a prize;
• interfere with another participant’s use of the Services;
• access systems or information without authorization;
• use automated systems to abuse or disrupt the website; or
• use PinSeekerz for unlawful purposes.
Violation of this section may result in cancellation of an entry, disqualification, prize forfeiture, suspension from future participation, or other appropriate action.9. FRAUD AND MISCONDUCT
PinSeekerz may investigate suspected fraud, cheating, manipulation, misuse, or violation of the Official Rules or these Terms.
Participants agree to reasonably cooperate with legitimate verification or fraud investigations.
PinSeekerz may preserve and review relevant records, including transaction information, video, course records, claim documents, and communications, when reasonably necessary to investigate a matter.10. PRIZES
Prizes are awarded only after successful verification under the applicable Official Rules.
A potential winning shot does not automatically create an entitlement to a prize.
Prize type, amount, method of fulfillment, and applicable restrictions are described in the Official Rules or challenge materials.
Participants are responsible for providing accurate information required for prize fulfillment.11. TAXES
Prize recipients are solely responsible for any federal, state, local, or other taxes arising from a prize unless otherwise required by law.
PinSeekerz may request information or documentation necessary to satisfy tax-reporting or withholding obligations.12. INTELLECTUAL PROPERTY
The PinSeekerz name, logo, branding, website design, graphics, software, written materials, challenge materials, and other content are owned by or licensed to PinSeekerz and are protected by applicable intellectual-property laws.
You may use the website and Services only for personal, lawful participation in PinSeekerz.
You may not reproduce, modify, distribute, sell, license, copy, or commercially exploit PinSeekerz content without prior written permission.
13. THIRD-PARTY SERVICES AND LINKS
The Services may link to or integrate with third-party services, including payment processors, participating golf clubs, partners and sponsors, insurers, software providers, and other websites or platforms.
PinSeekerz does not control third-party services and is not responsible for their content, availability, security, or independent practices.
Your use of a third-party service may be subject to that provider’s own terms and privacy policy.14. COMMUNICATIONS
By providing contact information, you consent to receive communications reasonably necessary to administer your entry, payment, claim, prize, or use of the Services.
These may include email, text message, telephone, or other communications where appropriate.
Marketing communications, if offered, will be handled separately and may be opted out of as provided in the applicable message or Privacy Policy.15. AVAILABILITY AND PROGRAM CHANGES
PinSeekerz may add, remove, suspend, modify, or discontinue participating clubs, eligible holes, challenge formats, entry methods, prizes, website features, technology, operating procedures, or other aspects of the Services.
Changes will not retroactively alter a properly verified prize claim unless permitted by the Official Rules or required by law.16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the PinSeekerz website and Services are provided on an “as is” and “as available” basis.
PinSeekerz does not warrant that the Services will always be available, that the website or technology will be error-free, that every eligible shot will be successfully recorded, that internet or third-party services will operate without interruption, or that use of the Services will meet every participant’s expectations.
Nothing in this section limits rights that cannot legally be excluded.17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, PinSeekerz and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the Services.
This may include losses arising from service interruptions, lost data, unavailable video, missed entries, third-party services, or inability to access the Services.
Any limitations of liability will apply only to the extent permitted by law.18. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless PinSeekerz and its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:
• your violation of these Terms;
• your violation of the Official Rules;
• fraudulent or unlawful conduct;
• your misuse of the Services; or
• your infringement of another person’s rights.19. SUSPENSION AND TERMINATION
PinSeekerz may suspend, restrict, or terminate access to the Services or future challenges if it reasonably believes a person has violated these Terms, violated the Official Rules, engaged in fraud or cheating, interfered with challenge equipment, abused staff, other participants, or participating clubs, or otherwise misused the Services.
Suspension or termination does not affect rights or obligations that arose before the suspension or termination.20. ELECTRONIC COMMUNICATIONS AND AGREEMENTS
You consent to receive agreements, disclosures, notices, and other records electronically.
Your electronic acceptance of these Terms, the Official Rules, Participant Waiver, or other agreements may have the same legal effect as a handwritten signature to the extent permitted by law.21. PRIVACY
PinSeekerz’s collection and use of personal information is governed by the Privacy Policy.
By using the Services, you acknowledge that you have had the opportunity to review the Privacy Policy.22. CHANGES TO THESE TERMS
PinSeekerz may update these Terms from time to time.
The current version will be posted on the PinSeekerz website with an updated effective date.
Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
Material changes affecting existing entries or claims will be handled consistently with the applicable Official Rules and applicable law.23. GOVERNING LAW
These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any venue provision, arbitration agreement, jury-trial waiver, or class-action waiver should be added only after review and approval by qualified legal counsel.24. SEVERABILITY
If any provision of these Terms is found unenforceable or invalid, the remaining provisions will remain in effect to the fullest extent permitted by law.25. NO WAIVER
PinSeekerz’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.26. ENTIRE AGREEMENT
These Terms, together with the applicable Official Rules, Participant Waiver, Privacy Policy, and any challenge-specific terms presented at entry, constitute the agreement between you and PinSeekerz concerning your use of the Services.
